Mike Fink is an accomplished Florida trial lawyer who has tried over 100 cases in both the Civil and Criminal Courts. With an extraordinary background in both civil and criminal law, Fink has tried civil cases involving millions of dollars and defended criminal clients facing life in prison.

In the civil arena, Fink has practiced for over a decade as a defense attorney and later as a plaintiff’s attorney. Fink began his legal career as an insurance defense attorney, representing major insurance companies and their insureds, state and local governments and private businesses and individuals. Notably, in the case of Bell v. Edison Mall, Fink successfully defended the Edison Mall against a wrongful death arising out of the mutilation murder of a teenage video arcade manager who was attacked on Halloween by a serial killer, who robbed and nearly decapitated him with a filet knife on Halloween.

As a plaintiff’s attorney, Fink has won millions of dollars for his clients in medical malpractice cases involving brain damaged children, wrongful death and personal injury cases as well as civil rights and employment discrimination cases where he has championed the rights of male educators who have been discriminated against in the workplace by their female counterparts. Fink’s experience as both a Defense and Plaintiff Attorney in the Civil arena and as a Criminal Defense Lawyer led one of Southwest Florida’s most popular magazine’s, Gulfshore Life Magazine, to list Mike Fink as the, “Go To Lawyer” in Southwest Florida in July 2007.

Within the past five years, Fink has also begun practicing criminal defense litigation, representing clients charged with both major and minor crimes in Southwest Florida. He has tried significant felony cases, including assault with a deadly weapon and an armed robbery life felony case as well standard misdemeanor cases such as DUI and resisting arrest.

In 2013, Fink appeared on the Dr. Phil Show (February 18th) involving one of his clients who was successfully defended from criminal prosecution for murder/vehicular homicide.

More recently, Fink filed a legal malpractice action on behalf of The Monaco Beach Club, Inc., a Naples, Florida high rise, beachfront condominium against its former attorneys who rejected an $11 million dollar settlement offer in a first party insurance case involving a claim for property damages caused by Hurricane Wilma and then lost the case at trial, recovering nothing. While the Monaco’s malpractice case was reviewed and rejected by several prominent attorneys before contacting Fink, Fink accepted the case and immediately filed suit before the two-year statute of limitations expired. Fink charged that the defendant attorneys had negligently failed to settle the case by failing to recommend and advise the Monaco to a settle its claims for between $9 million and $13 million dollars, or $11 million dollars, since that amount represented the “full value” of the Monaco’s covered, hurricane related property damages. Facing Fink’s simple, “negligent failure to settle” theory, 4 of the 5 defendants opted to settle the Monaco’s claims within the first 6 months, before filing answers. A final confidential settlement was reached 8 months later against the target defendant who was covered by a $5 million dollar professional liability insurance policy.
